1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "Resident," "Family," or "you") and kinnarna ("we," "us," or "our") regarding your use of our senior care services and website.
By enrolling in our services, visiting our facility, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services or website.
These Terms apply to all users of our services, including residents, family representatives, visitors, and website users.
2. Definitions
- Services: All senior care programs offered by kinnarna, including Daytime Companionship, Assisted Living, and Premium Private Residence.
- Resident: An individual enrolled in and receiving kinnarna services.
- Family Representative: The authorized individual responsible for resident enrollment, care decisions, and financial obligations.
- Care Plan: The individualized service and support plan developed for each resident.
- Facility: kinnarna's physical location at 76/2 Moo 3, Mae Rim-Samoeng Road, Mae Rim, Chiang Mai 50180, Thailand.
3. Eligibility and Enrollment
3.1 Age Requirement
Services are designed for individuals aged 55 and older. Enrollment requires that the resident or family representative be at least 18 years of age to enter into this agreement.
3.2 Assessment Process
Prior to enrollment, we conduct an assessment to determine appropriate service levels and ensure we can meet the individual's care needs. We reserve the right to decline enrollment if we determine our facility cannot adequately address specific needs.
3.3 Required Documentation
Enrollment requires completion of:
- Service agreement and care consent forms
- Health information disclosure and assessment
- Emergency contact information
- Payment authorization
- Acknowledgment of facility policies
4. Services Provided
4.1 Scope of Services
kinnarna provides non-medical residential care and companionship services. We do not provide medical treatment, nursing care, or acute healthcare services. Residents requiring medical attention will be referred to appropriate healthcare providers.
4.2 Service Modifications
We reserve the right to modify service offerings, schedules, and facility amenities with reasonable notice. Significant changes affecting enrolled residents will be communicated at least 30 days in advance.
4.3 Care Plan Adjustments
Care plans are reviewed monthly and may be adjusted based on changing needs, safety considerations, or staff recommendations. Family representatives will be consulted before significant care plan changes.
5. Fees and Payment
5.1 Service Fees
Monthly fees are as follows:
- Daytime Companionship and Activities: ฿9,500 per month
- Assisted Living Arrangement: ฿35,000 per month
- Premium Private Residence: ฿58,500 per month
5.2 Payment Terms
Fees are due on the first day of each month. Payment may be made by bank transfer, check, or credit card. A late fee of 5% will be applied to payments received after the 10th day of the month.
5.3 Fee Increases
We reserve the right to adjust fees annually to reflect operational costs. Fee increases will be communicated 60 days in advance and will not exceed 10% per year.
5.4 Additional Charges
Certain services incur additional costs, including:
- Personal items and toiletries
- Specialized dietary supplements
- Off-site excursions beyond standard programming
- Individual professional services arranged at family request
5.5 Refund Policy
Monthly fees are non-refundable once the service month has begun. For residential services, one month's notice is required for service termination. Failure to provide notice results in forfeiture of deposit or advance payment.
6. Resident Rights and Responsibilities
6.1 Resident Rights
All residents have the right to:
- Respectful and dignified treatment
- Privacy and confidentiality of personal information
- Participate in or decline activities
- Voice concerns and provide feedback
- Maintain personal belongings within reason
- Receive visitors during designated hours
- Review their care plan and records
6.2 Resident Responsibilities
Residents and family representatives are expected to:
- Treat staff and other residents with respect
- Follow facility policies and safety guidelines
- Communicate care needs and preferences clearly
- Provide accurate health information
- Ensure timely payment of fees
- Notify staff of schedule changes or absences
7. Health and Safety
7.1 Medical Emergencies
In the event of a medical emergency, we will contact emergency services and notify family representatives immediately. We are not responsible for medical treatment costs incurred during emergencies.
7.2 Infectious Disease
We maintain protocols for managing infectious diseases to protect residents and staff. Residents with contagious conditions may be temporarily excluded from group activities or asked to seek medical treatment before returning.
7.3 Personal Belongings
While we take reasonable precautions, kinnarna is not liable for loss or damage to personal belongings. We recommend not bringing valuable items to the facility.
8. Termination of Services
8.1 Voluntary Termination
Family representatives may terminate services with 30 days written notice. For Daytime Companionship, two weeks notice is sufficient.
8.2 Involuntary Termination
We reserve the right to terminate services if:
- Resident's care needs exceed our capabilities
- Resident or family engages in abusive or threatening behavior
- Payment obligations are not met within 30 days of due date
- Facility policies are repeatedly violated
In cases of involuntary termination, we will provide 30 days notice when possible and assist with transition planning.
9. Limitation of Liability
kinnarna provides services with reasonable care and professional standards. However, we are not liable for:
- Medical conditions or health changes occurring naturally
- Injuries sustained during voluntary activities or outings
- Loss or damage to personal property
- Consequences of resident decisions made against staff advice
- Events beyond our reasonable control (force majeure)
Our total liability for any claim shall not exceed the total fees paid in the six months preceding the claim.
10. Privacy and Confidentiality
We maintain strict confidentiality of resident information in accordance with our Privacy Policy and Thailand's Personal Data Protection Act. Please refer to our Privacy Policy for detailed information on data handling.
11. Dispute Resolution
11.1 Informal Resolution
We encourage families to raise concerns directly with our management team. Most issues can be resolved through open communication and collaborative problem-solving.
11.2 Mediation
If informal resolution fails, both parties agree to attempt mediation before pursuing legal action. Mediation costs will be shared equally.
11.3 Governing Law
These Terms are governed by the laws of Thailand. Any legal proceedings shall be conducted in Chiang Mai courts.
12. Website Use
12.1 Intellectual Property
All website content, including text, images, logos, and design, is owned by kinnarna and protected by copyright. You may view and print content for personal use but may not reproduce, distribute, or commercially exploit it.
12.2 Prohibited Activities
You may not:
- Access or attempt to access unauthorized areas
- Interfere with website functionality
- Transmit harmful code or malware
- Collect user information without consent
- Use the website for unlawful purposes
13. Changes to Terms
We may update these Terms periodically to reflect changes in our practices or legal requirements. Updated terms will be posted on our website with a revised "Last Updated" date.
For enrolled residents, significant changes will be communicated by email or written notice 30 days before they take effect. Continued use of services after changes indicates acceptance of updated terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
